By using our website, requesting a quote, placing an order, approving a proposal, paying a deposit, scheduling a consultation, or purchasing products or services from Elemento Living, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or purchase products or services from Elemento Living.
Elemento Living is a curated outdoor furniture, shade, and exterior product resource serving homeowners, designers, architects, developers, estate managers, and trade professionals.
Elemento Living offers outdoor furniture, shade products, accessories, materials, product selections, design support, showroom consultations, procurement coordination, delivery coordination, and related services.
Elemento Living is affiliated with CPS Outdoors. CPS Outdoors provides pool construction and outdoor construction services. Elemento Living focuses on furniture, shade, outdoor products, and related design support.
You may use our website for lawful purposes only.
You agree not to:
Use the website in a way that violates any applicable law.
Interfere with the security or operation of the website.
Attempt to gain unauthorized access to any part of the website.
Copy, scrape, reproduce, or misuse website content without permission.
Submit false, misleading, or incomplete information.
We may restrict, suspend, or terminate access to the website at any time if we believe these Terms have been violated.

Product availability and lead times are subject to manufacturer, vendor, freight, customs, and supply chain conditions.
Elemento Living is not responsible for minor variations in color, finish, material texture, natural characteristics, or manufacturer tolerances.
Quotes and proposals are estimates based on the information available at the time they are prepared.
Unless otherwise stated in writing:
Quotes are valid for [15 / 30] days.
Pricing is subject to change before order confirmation.
Taxes, freight, delivery, storage, installation, receiving, assembly, white-glove services, and other charges may be additional.
Vendor price increases, tariffs, fuel surcharges, freight increases, currency fluctuations, or availability changes may affect final pricing.
Errors or omissions in quotes, proposals, invoices, or website pricing may be corrected by Elemento Living.
A quote does not reserve inventory or guarantee pricing until the required deposit or payment has been received and the order has been accepted by Elemento Living.
An order is not final until:
The client approves the quote, proposal, invoice, or order confirmation.
The required deposit or payment is received.
Elemento Living accepts the order.
Any required product selections, finishes, fabrics, dimensions, and specifications are confirmed.
Once an order is approved and placed with a manufacturer, vendor, or supplier, the order may not be cancelable.
Custom orders, special orders, made-to-order items, imported items, limited availability items, and trade orders are subject to stricter cancellation, return, and refund limitations.
Elemento Living may require deposits, progress payments, or full payment before ordering products or scheduling services.
Unless otherwise stated in writing:
Deposits are required before products are ordered.
Deposits may be non-refundable once an order has been placed with a vendor or manufacturer.
Final payment is due before delivery, installation, release of goods, or completion of services.
Elemento Living may pause ordering, delivery, installation, or services if payments are overdue.
Client is responsible for all approved charges, including product costs, freight, taxes, delivery, storage, installation, and related fees.
Returned payments, chargebacks, or failed payments may result in additional fees, collection costs, or suspension of services.
Many products sold by Elemento Living may be custom, made-to-order, special order, imported, configured, or ordered specifically for the client.
Custom and special-order items may include, but are not limited to:
Outdoor furniture
Upholstery
Cushions
Fabrics
Umbrellas
Shade systems
Planters
Finishes
Materials
Accessories
Products ordered in non-stock sizes, colors, finishes, or configurations
Unless otherwise stated in writing, custom and special-order items are final sale and may not be canceled, returned, exchanged, or refunded once ordered.
The client is responsible for reviewing and approving all specifications before ordering.
Elemento Living may offer trade pricing, trade access, or trade support to approved designers, architects, landscape architects, developers, purchasing agents, and other qualified trade professionals.
Trade pricing and benefits are discretionary and may be modified, suspended, or discontinued at any time.
Trade professionals are responsible for:
Providing accurate client and project information.
Reviewing all quotes and specifications before approval.
Communicating product limitations, care requirements, lead times, and terms to their clients.
Ensuring timely payment.
Coordinating approvals where applicable.
Elemento Living may require trade account approval, business information, resale certificates, project information, or other documentation.
Elemento Living may provide design support, product selection support, showroom consultations, mood boards, layouts, product recommendations, furniture plans, or other design-related services.
Unless otherwise stated in a signed agreement:
Design support is conceptual and advisory.
Product recommendations are based on information provided by the client or trade professional.
The client is responsible for final approval of selections, dimensions, quantities, finishes, fabrics, and site suitability.
Elemento Living is not responsible for architectural, engineering, structural, code, permitting, drainage, electrical, or site-condition issues unless specifically agreed in writing.
Renderings, layouts, mood boards, and visual materials are illustrative and may not represent exact dimensions, colors, finishes, or field conditions.
Design fees, if applicable, are separate from product purchases unless otherwise stated in writing.
The client is responsible for providing accurate site information unless Elemento Living agrees in writing to provide measurement or site verification services.
Client is responsible for confirming:
Dimensions
Clearances
Access paths
Elevator sizes
Door openings
Stairways
Rooftop access
Delivery restrictions
HOA, building, condo, or property rules
Installation requirements
Site readiness
Elemento Living is not responsible for products that do not fit, cannot be delivered, or cannot be installed due to inaccurate information, limited access, site restrictions, or unapproved site conditions.
Additional charges may apply for failed deliveries, difficult access, rescheduling, hoisting, special equipment, storage, or additional labor.
Lead times are estimates only.
Lead times may be affected by:
Manufacturer production schedules
Material availability
Freight delays
Customs delays
Weather
Port congestion
Vendor delays
Carrier delays
Supply chain conditions
Force majeure events
Elemento Living is not responsible for delays outside its reasonable control.
If a product becomes unavailable, delayed, discontinued, or materially changed, Elemento Living may recommend alternatives or provide updated timing.
Shipping, freight, receiving, delivery, assembly, installation, placement, storage, and white-glove services may be quoted separately.
Unless otherwise stated in writing:
Delivery dates are estimates.
Client must ensure the delivery location is ready and accessible.
Client or authorized representative must be present to receive delivery unless otherwise agreed.
Additional fees may apply for missed deliveries, rescheduling, waiting time, storage, difficult access, stairs, elevators, hoisting, special handling, or after-hours delivery.
Elemento Living is not responsible for delays caused by buildings, associations, security requirements, access restrictions, weather, site conditions, or third-party carriers.
Installation, assembly, or placement services are limited to the scope stated in the applicable quote, proposal, or invoice.
Client or client’s authorized representative must inspect products upon delivery or pickup.
Any visible damage, shortage, defect, or incorrect item must be noted immediately on delivery documents and reported to Elemento Living within [24 / 48] hours of receipt.
Failure to timely report damage, missing items, or delivery issues may limit available remedies.
Packaging should be retained until the issue is reviewed.
Do not use, install, alter, or dispose of damaged or disputed items unless instructed by Elemento Living.
If products arrive before the client is ready to receive them, storage fees may apply.
Storage may be required if:
The site is not ready.
Delivery is delayed by the client.
Building access is unavailable.
Payment is incomplete.
Client requests delayed delivery.
Elemento Living is not responsible for damage, deterioration, or additional costs caused by extended storage, delayed delivery, or client-caused postponement.
Return eligibility depends on the product type, vendor terms, condition of the item, timing, and whether the item was custom, special order, made-to-order, imported, installed, assembled, used, or final sale.
Unless otherwise stated in writing:
Custom orders are final sale.
Special orders are final sale.
Made-to-order items are final sale.
Imported items are final sale.
Installed, assembled, used, damaged, altered, or weather-exposed items are not returnable.
Clearance, floor sample, discontinued, or final sale items are not returnable.
Shipping, freight, delivery, installation, storage, and service fees are non-refundable.
Approved returns may be subject to restocking fees, vendor fees, freight fees, and return shipping costs.
No return, exchange, cancellation, or refund is available unless approved in writing by Elemento Living.
Products may be covered by manufacturer warranties.
Manufacturer warranties vary by product, brand, material, finish, fabric, and use.
Elemento Living does not independently manufacture most products and does not provide warranties beyond those expressly stated by the applicable manufacturer or in a signed written agreement.
Warranty claims are subject to manufacturer review and approval.
Warranties may not cover:
Normal wear and tear
Outdoor exposure
Fading
Weathering
Salt air corrosion
Mold or mildew
Improper cleaning
Misuse
Neglect
Accidents
Commercial use unless approved
Improper installation
Unauthorized repairs
Modifications
Damage caused by weather, wind, hurricanes, storms, or force majeure events
Client is responsible for following all product care and maintenance instructions.
Outdoor furniture and products require proper care and maintenance.
Client understands that outdoor products may be affected by:
Sun exposure
UV exposure
Salt air
Humidity
Rain
Wind
Pool chemicals
Irrigation
Cleaning products
Mold or mildew
Extreme weather
Hurricanes or tropical storms
Client is responsible for maintaining, covering, securing, storing, and protecting products as appropriate.
Elemento Living is not responsible for damage caused by improper maintenance, failure to secure items, severe weather, or environmental exposure.
Client is responsible for providing accurate, complete, and timely information.
Elemento Living may rely on information provided by the client, designer, architect, contractor, property manager, building representative, or other authorized person.
Elemento Living is not responsible for errors, delays, costs, or unsuitable products resulting from inaccurate or incomplete information provided by others.
Elemento Living may work with third-party manufacturers, vendors, carriers, installers, receivers, warehouses, trades, and service providers.
Elemento Living is not responsible for third-party delays, discontinuations, manufacturing defects, warranty determinations, freight issues, or service failures beyond its reasonable control.
When appropriate, Elemento Living may assist in coordinating with third parties, but final responsibility may remain subject to the third party’s terms and policies.
All website content, designs, text, images, graphics, logos, layouts, product presentations, mood boards, proposals, drawings, renderings, and other materials created or provided by Elemento Living are protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, display, publish, or use Elemento Living content without written permission.
Design concepts, proposals, presentations, product selections, layouts, and visual materials remain the property of Elemento Living unless otherwise agreed in writing.
If you submit photos, project information, testimonials, reviews, comments, or other materials to Elemento Living, you grant Elemento Living permission to use those materials for business, marketing, internal, and promotional purposes unless otherwise agreed in writing.
Elemento Living may edit submissions for clarity, length, or formatting.
You represent that you have the right to provide any materials you submit.
Elemento Living may request permission to photograph or document completed installations, showroom visits, events, or projects.
No private residence or client-identifying information will be publicly used without appropriate permission.
Project photography may be subject to separate written approval.
The Elemento Living website may contain links to third-party websites, manufacturer websites, vendor pages, social media platforms, or external resources.
Elemento Living is not responsible for third-party content, accuracy, policies, products, services, or websites.
Use of third-party websites is at your own risk.
Elemento Living makes reasonable efforts to provide accurate information and quality service.
However, the website, products, services, and information are provided “as available” and “as is” except as expressly stated in writing.
To the fullest extent permitted by law, Elemento Living disclaims all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions may not allow certain warranty exclusions, so some exclusions may not apply to you.

Elemento Living’s total liability for any claim shall not exceed the amount paid by the client to Elemento Living for the specific product or service giving rise to the claim.
You agree to indemnify and hold harmless Elemento Living, its owners, employees, representatives, affiliates, vendors, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from:
Your use of the website.
Your violation of these Terms.
Your inaccurate information.
Your misuse of products.
Your failure to follow care instructions.
Your unauthorized use of Elemento Living materials.
Your violation of any law or third-party rights.
Elemento Living is not responsible for delay or failure to perform due to events beyond its reasonable control, including but not limited to:

Hurricanes
Flooding

Acts of government

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from these Terms, website use, products, services, or transactions with Elemento Living shall be handled in the state or federal courts located in Miami-Dade County, Florida, unless otherwise required by law.
Before filing any legal claim, you agree to first contact Elemento Living and attempt to resolve the dispute informally.
Elemento Living will make reasonable efforts to review and respond to disputes in good faith.
Nothing in this section limits either party’s right to seek urgent or equitable relief where appropriate.
